29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, the employer did not have a person who was certified in first aid training (which includes Basic First Aid and CPR) at this job site available to render first aid. On or about 21 December 2018, and at times prior thereto, the employer did not ensure personnel certified in first aid training were readily accessible to the job site located at 8023 West Parmer Lane, Austin, TX. A worker was struck to the head by a piece of cinder block, resulting in Hospitalization from severe head injuries, such as a fractured skull and traumatic brain injury. Williamson County Emergency Medical Services (EMS) took approximately 8 minutes 15 seconds to reach the worker after the first notification.

29 CFR 1926.451(h)(2)(i): Where there was a danger of tools, materials, or equipment falling from a scaffold and striking employees below, the area below the scaffold was not barricaded to prevent employees from entering. On 21 December 2018, a piece of cinder block fell off a scaffold platform from five levels high during dismantling, striking a worker below. The area around the scaffold was not barricaded to prevent access, exposing workers in the area to the hazard of being struck by falling materials, tools, and debris from a height of approximately 32 feet 10 inches.
