29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. On or about December 21, 2018, and at times prior thereto, the employer did not conduct frequent jobsite safety inspections to identify and provide a workplace were any employee, worker, laborer, or mechanic employed in the performance of the contract work was free from recognized hazards such as but not limited to: a) On November, 2018 and December 15, 2018, workers worked from unguarded balconies without fall protection. Workers worked from aerial lifts climbed on to unguarded balconies, exposing them to a fall hazard of up to a 30 feet to the ground below; b) On November 2, 2018 and December 15, 2018, workers worked from aerial lifts with out being tied off; exposing the them to fall hazards of up to 30 feet to the ground below; c) On November 2, 2018 and December 15, 2018, workers worked on unguarded openings, such as window openings, door openings etc., without fall protection and were exposed to a fall hazard of up to 30 feet to the ground below. d) workers on the scaffold system worked without guard rails, ladder, and training on the hazards of the scaffolding, exposing the them to fall hazards of up to 50 feet to the ground below; Buildings 3 and 5.
