29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): JOHNSON + MEMORIAL WOUND AND HYPERBARIC CENTER: On or about and at times prior to March 12, 2019, the employer had not conducted a PPE Hazard Assessment to determine what personal protective equipment employees would wear when using a cast saw to remove casts from patients. Employees were provided with surgical masks to protect themselves from "nuisance dust".

29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: WOUND CARE CENTER: On or about and at times prior to March 12, 2019, the employer provided employees with surgical masks to wear voluntarily to protect themselves from the dust generated when cutting cast materials with a saw. The surgical masks were not NIOSH-certified.
