29 CFR 1926.152(i)(6): In locations where flammable vapors could have been present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition.  a.  On or about December 29, 2018, at the above addressed jobsite, several ignition sources were present in an area  which employees were performing roofing operations where flammable vapors were present. Employees were thereby exposed to the hazards associated with fires.

29 CFR 1926.352(c): Welding, cutting, or heating was done where the application of flammable paints, or the presence of other flammable compounds, or heavy dust concentrations created a hazard.  a.  On or about December 29, 2018, at the above addressed jobsite, a torch was used, in the presence of flammable vapors, to dry concrete when performing roofing operations, thereby exposing employees to the hazards related to fires.

On or about December 29, 2018, at the above addressed jobsite, the employer did not identify and evaluate hazards, such as, but not limited to, use of flammable materials, limited means of access/egress and ignition sources prior to employees entering permit required confined spaces, thereby exposing employees to hazards associated with permit required confined space while performing roofing operations.

29 CFR 1926.1204(c): The employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to, the following:    a.  On or about December 29, 2018, at the above address jobsite, employees were exposed to hazards associated with confined spaces while conducting roofing operations.  The employer failed to implement procedures and practices including but not limited, to defining acceptable entry conditions; provide entrant(s) with opportunity to evaluate or observe results of monitoring or testing of permit spaces; purging, inerting, flushing, or ventilating procedures to eliminate or control atmospheric hazards; and, ensure conditions in the permit space were acceptable for entry throughout the duration permit space entry.

On or about December 29, 2018, at the above addressed jobsite the employer did not provide equipment necessary for entry into a confined space, thereby exposing employees to the hazards associated with confined spaces.  Equipment required but not provided includes, but was not limited to ventilating equipment, testing and monitoring equipment, personal protective equipment, and lighting equipment.
