29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At a commercial construction site located at 3022 S Belt Hwy, Saint Joseph, MO: Employees were exposed to harmful chemicals that could cause injuries and/or illnesses in that the employer had not developed, or implemented, a written hazard communication program. This was demonstrated at the construction site when 2 employees were dispensing paint from a paint gun to the exterior of the building.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  At a commercial worksite located at 3022 S Belt Highway, Saint Joseph, MO: Employees were exposed to fall hazards. One employee was assisting the owner in the painting of the upper portion of the commercial building. The employee was not protected from falling by the use of guardrail systems, safety net system, or personal fall arrest system. The employee accessed the top of the refrigerant container located below the condenser units to give the employer that paint gun.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  At a commercial worksite located at 3022 S Belt Highway, Saint Joseph, MO: Employees were exposed to respiratory hazards. Employees were exposed to, but not limited to ConFlex XL: Smooth High Build Acrylic Coating. This chemical contains (crystalline silica, respirable powder) and no assessment had been performed to determine employee exposure.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:  At a commercial construction site located at 3022 S Belt Hwy, Saint Joseph, MO: Employees were exposed to respiratory hazards associated with respirarable crystalline silica when performing painting operations. The employer did not establish and provide a written exposure control plan in regards to silica in order to properly assess the exposure of employees who were exposed to crystalline silica at or above the action levels in order to make frequent and regular inspections of job sites, materials, and equipment in order to implement the written exposure control plan and to protect the employees from known respiratory hazards associated with a silica.
