29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d): (a) In the bagging area, on or about December 28, 2018 and at times prior to, the employer did not implement feasible engineering controls or work practices to reduce and maintain employee airborne particulate (Total Dust) exposure to or below the permissible exposure limit of 15 milligrams per cubic meter of air for an employee that was exposed to a time-weighted average of 30.5 milligrams per cubic meter of air exposing the employee to a respiratory hazard. (b) In the bagging area, on or about December 28, 2018 and at times prior to, the employer did not implement feasible engineering controls or work practices to reduce and maintain employee airborne particulate (Total Dust) exposure to or below the permissible exposure limit of 15 milligrams per cubic meter of air for an employee that was exposed to a time-weighted average of 21.4 milligrams per cubic meter of air exposing the employee to a respiratory hazard.
