OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards.    a) Building 2 - on or about January 3, 2019, the employer did not ensure that rack columns were anchored to the floor with anchor bolts adequate to resist all applicable forces.    b) Building 2- on or about January 3, 2019, storage and material created a hazard in that steel storage racks had two serious bent columns that were not immediately unloaded and damaged portions were not replaced.    Among other methods, one feasible and acceptable means of abatement would be to anchor all rack columns to the floor with anchor bolts to resist all applicable forces and upon any visible damage, the pertinent portions of the rack should be removed from service until the damaged portion is replaced in accordance with ANSI MH16.1:2012, Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks, Section 1.4.7 and 1.4.9.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards related to operating a forklift without seatbelt use.    a) Building 1 and 2 - on or about January 3, 2019, employees operated LPG forklifts for storage and warehousing operations, but the employer did not require employees to use the installed seatbelts during operations, exposing employees to crushing hazards in the event the operator was to become unseated.    Among other methods, one feasible and acceptable method to correct these hazards, are to utilize the installed restraint system in accordance with the current version of American National Standards Institute (ANSI) B56.1, "Safety Standards for Low Lift and High Lift Trucks", Section 7.41 which states, "Counterbalanced, center control, high lift trucks that have sit-down, non-elevating operator position shall have a restraint device, system, or enclosure that is intended to assist the operator in reducing the risk of entrapment of the operator's head and/or torso between the truck and ground in the event of a tip-over".

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    a) Building 1 and 2 - on or about January 3, 2019, employees operated LPG forklifts without completing practical training and evaluations, exposing the employees and surrounding employees to forklift hazards.

29 CFR 1910.305(g)(1)(iv): Flexible cords and/ or cables were used for purposes prohibited by paragraphs (A) through (F) of 29 CFR 1910.305(g)(1)(iv):  a) Building 1 - on or about January 3, 2019, a flexible extension cord was used as a substitute for fixed wiring and was observed running through holes in walls, attached to building surfaces to power the camera security system.
