29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On January 3, 2019, at 8 South Main St. Peebles, a Toyota sit-down propane powered forklift truck in operation had an inoperative horn and was not taken out of service.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). The employer had not ensured an employee successfully completed the training required by paragraph (l) prior to operating the Toyota sit-down forklift at the Grandview Flooring Outlet Store at 8 South Main St. Peebles. Grandview Building & Supply, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR1910.178(l)(1)(ii), which was contained in OSHA inspection number 1316370, citation number 1, item number 1 and was affirmed as a final order on July 3, 2018, with respect to a workplace located at_ 165 N. Main St. Peebles, OH 45660.
