29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    On 1/2/2019, employees of Paige Foundation Repair, LLC, Dba: Acculift Foundation Repair were repairing a foundation of a commercial building located at 12678 Veterans Memorial Parkway, Wentzville, MO 63385.  The employer failed to instruct and train employees to recognize, avoid, and prevent potential engulfment and struck-by hazards associated with trenching and excavations.

29 CFR 1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmet.    On 1/2/2019, employees of Paige Foundation Repair, LLC, Dba: Acculift Foundation Repair were repairing a foundation of a commercial building located at 12678 Veterans Memorial Parkway, Wentzville, MO 63385. Employees were working inside of an excavation approximately 4 feet, 11 inches in depth and not wearing protective helmets exposing themselves to a potential struck by hazard.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:     On 1/2/2019, employees of Paige Foundation Repair, LLC, Dba: Acculift Foundation Repair were repairing a foundation of a commercial building located at 12678 Veterans Memorial Parkway, Wentzville, MO 63385.  The employer did not provide or ensure that a safe means of egress was located inside an excavation which was measured at 4 feet, 11 inches.

Excavated soil materials were not placed 2 feet from the edge of the excavation.  Employees working in the excavation were exposed to struck by hazards from rocks and soil above.

An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.     On 1/2/2019, employees of Paige Foundation Repair, LLC, Dba: Acculift Foundation Repair were repairing a foundation of a commercial building located at 12678 Veterans Memorial Parkway, Wentzville, MO 63385.  The employer did not ensure a competent person inspected the excavation and surrounding areas to identify any potential hazards prior to the start of work.
