OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from drop starting chainsaws and not wearing proper personal protective equipment (PPE). On or about January 9, 2019 and times prior employees dropped started chainsaws in preparation of cutting pole ends to size, and not wearing PPE equipment such as eye and/or face protection to protect from flying chips and chaps to prevent potential cuts. The employer was in possession of the instruction manual for the STIHL MS 461 chainsaw which discusses drop starting and PPE requirements.
