29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assessed and limited the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:    (a)  Vertigo Construction , Strawberry Street & River Street- Employees used a Stihl hand-held power saw to cut the concrete pad.  The employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for hand-held power saws on Table 1 in that while one employee operated the saw to cut the concrete a second employee used a bucket full of water to manually pour water on the sawing operation rather using the saw's integrated water delivery system to continuously feed water to the saw blade as required by Table 1, exposing the employees to potential over exposure to respirable crystalline silica, on or about January 7, 2019.    Corrected during the inspection.  No abatement certification or documentation required.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  (a) Vertigo Construction, Strawberry St. & River St. - To cut the concrete pad, employees used a Stihl hand-held power saw without using an integrated water delivery system to continuously feed water to the blade as required by Table 1, and the employer did not assess the silica exposure of each employee in accordance with either the performance option or the scheduled monitoring option, exposing the employees to potential over exposure to respirable crystalline silica, on or about January 7, 2019.  Corrected during the inspection.  No abatement certification or documentation required.
