Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck-by flying shrapnel in the event the polyvinyl chloride (PVC) pipe used to transport compressed air were to explode.  On or about January 19, 2019, and times prior thereto, where employees worked below and within one to two feet from Schedule 40 PVC pipe that was used to transport compressed air in the shop area for use in manufacturing trailers.  The installed PVC pipe was not protected against any external forces or stresses.  The installed pipe was not designed to transport compressed air.

29 CFR 1910.305(b)(2)(i): Pull boxes, junction boxes, and fittings were not provided with covers approved for the purpose:  On or about January 8, 2019, and times prior thereto, in Bay #6 located in the Shop Area on the West wall, employees were exposed to electrical and fire hazards from a junction box that was not equipped with a cover.

29 CFR 1910.305(d)(2): Panelboards were not mounted in cabinets, cutout boxes, or enclosures designed for the purpose and/or were not dead front:  On or about January 8, 2019, and times prior thereto, on the West wall located in Bay #6 of the Shop Area, employees were exposed to electrical and fire hazards from an electrical box that was not equipped with a dead front cover.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about January 8, 2019, and times prior thereto, throughout the facility, where employees were exposed to struck-by hazards when operating forklifts to move merchandise and other material without formal and practical training and evaluation of the operator's performance in the workplace.
