29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Riverview Landing Apartments, Third floor: On or about 01/09/2019, and at times prior, the employer exposed employees to fall hazards of 22-feet, 8-inches to the lower level, in that a fall protection system was not provided in the location where employees were engaged in framing activities.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  (a) Riverview Landing Apartments, Third floor: On or about 01/09/2019, and at times prior, the employer provided fall protection training which was not retained or practiced on site as employees were exposed to fall hazards of 22-feet, 8-inches at the leading edge, in that employees engaged in framing activities were not adequately trained to recognize fall hazards on the upper levels.
