29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:     On 1/9/2019, employees of St. Charles County Piping, Inc. were installing a storm water system of a commercial building located at 2181 West Terra Lane, OFallon, MO 63366.  The employer failed to instruct and train employees to recognize, avoid, and prevent potential engulfment and struck-by hazards associated with trenching and excavations.

29 CFR 1926.651(j)(2):  Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    On 1/9/2019, employees of St. Charles County Piping, Inc. were installing a storm water system of a commercial building located at 2181 West Terra Lane, OFallon, MO 63366.  A skid steer was operating to the Southside of the trench within 2 feet from the edge exposing an employee to struck-by hazards from rocks and soil above.

29 CFR 1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmet.  On 1/9/2019, employees of St. Charles County Piping, Inc. were installing a storm water system of a commercial building located at 2181 West Terra Lane, OFallon, MO 63366.  A employee was working inside a trench measuring approximately 6 feet, 6 inches in depth; 5 feet in width and 120 feet in length.  Protective helmets were not worn by employees exposing themselves to a potential struck by hazard which could result in head injuries or death.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems was not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.     On 1/9/2019, employees of St. Charles County Piping, Inc. were installing a storm water system of a commercial building located at 2181 West Terra Lane, OFallon, MO 63366.  The employer did not ensure a competent person inspected the excavation and surrounding areas to identify any potential hazards prior to the start of work.

29 CFR 1926.652(a)(1):  Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    On 1/9/2019, employees of St. Charles County Piping, Inc. were installing a storm water system of a commercial building located at 2181 West Terra Lane, OFallon, MO 63366. The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in excavations were protected from engulfment hazards. The trench measured approximately 6.5 feet in depth, 5 feet in width and 125 feet in length.
