29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about January 8, 2019, the employer had not established a written lock-out/tag-out program for the facility for such machines as, but not limited to the Cantek cut off saw and other machines on site as required.

29 CFR 1910.213(a)(12): For all circular saws where conditions are such that there is a possibility of contact with the portion of the saw either beneath or behind the table, that portion of the saw shall be covered with an exhaust hood, or, if no exhaust system is required, with a guard that shall be so arranged as to prevent accidental contact with the saw. On or about January 8, 2019, the Cantek cut-off/up-cut saw in the bundling area did not have proper guarding in place to prevent accidental contact with the blade.
