29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    (a)BTY Construction at 317 5th Avenue C, Brookings, SD 57006:  On or about and at times prior to January 9, 2019, the employer did not ensure that each employee was protected from falls from heights in that, two employees were conducting framing operations over an existing flat roof with no fall protection system in place.  This condition exposed the employees to a fall hazard of approximately 12 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a)BTY Construction at 317 5th Avenue C, Brookings, SD 57006: On or about and at times prior to January 9, 2019, the employer did not ensure that each employee engaged in framing operations on a commercial property, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 12 feet.
