29 CFR 1926.200(g)(2): All traffic control signs or devices used for protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices ("MUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference:       a. On or about January 10, 2019, at the above referenced inspection site, employees were required to act as flaggers in a traffic zone to provide traffic control to a construction zone (paving). The employer failed to provide signage in accordance with the MUTCD. Employees were thereby exposed to struck-by hazards.   b. On or about January 10, 2019, at the above referenced inspection site, employees were required to act as flaggers in a traffic zone to provide traffic control to a construction zone (paving). The employer failed to ensure employees acted in accordance with the MUTCD. Employees engaged in flagging entered and walked in the lane of traffic. Employees were thereby exposed to struck-by hazards.   c. On or about January 10, 2018, at the above referenced inspection site, employees were required to act as flaggers in a traffic zone to provide traffic control to a construction zone (paving). The employer failed to train employees to the temporary traffic control plan, as developed by the contractor, in accordance with the MUTCD. Employees were thereby exposed to struck-by hazards.   There is no abatement certification or documentation required for this item.
