OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to bone fractures/amputation hazards:    a) Site, House #8 - On or about 01/09/19 and at times prior thereto the feed cart did not have emergency stop devices installed and accessible to workers in case of an emergency.    b) Site, House #8 - On or about 01/09/19 and at times prior thereto horizontal and vertical conveyors did not have emergency stop devices installed and accessible to workers in case of emergency.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by guardrail systems, safety net systems, or personal fall protection systems such as personal fall arrest, travel restraint, or positioning systems:    a) Site, House #8 - On or about 01/09/19 and at times prior thereto employees climbed on the sides of the metallic cage structure in order to access the cages in the upper levels, and were exposed to falls from a 52 in.  (4.0 ft. 8.0 in.) elevation onto the concrete floor.    On the alternative:    OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards:      a) Site, House #8 - On or about 01/09/19 and at times prior thereto employees climbed on the sides of the metallic structure in order to access the cages in the upper levels. The employer did not provide a safe, stable working surface to prevent the fall of employees onto the concrete floor.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    a) Site - On or about 01/09/19 and at times prior thereto employees performed maintenance/repairs of equipment including (but not limited to) horizontal conveyors, vertical conveyors, electric motors, fans, manure belt and drying system, boiler system, air compressors, trash compactors, and additional machinery in the company's inventory list of 01/16/19 which is subjected to lockout/tagout. The employer did not develop, implement, and utilize written specific lockout/tagout procedures to protect workers from moving/rotating parts, electrical energy, and compressed air.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1910.219(c)(2)(i): All exposed part(s) of horizontal shafting seven (7) feet or less from floor or working platform were not protected by stationary casing(s) enclosing shafting completely or by trough(s) enclosing sides and top or sides and bottom of shafting:    a) Site, House #8 - On or about 01/09/19 and at times prior thereto the shafts and couplings that powered the vertical conveyors were not guarded to prevent contact with nip points and protruding bolts.     Or in the alternative:    29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, and rotating parts:    a) Site, House #8 - On or about 01/09/19 and at times prior thereto the shafts and couplings that powered the vertical conveyors were not guarded to prevent contact with nip points and protruding bolts.
