29 CFR 1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmet.    The employer is failing to protect employees from struck-by hazards associated with working in trenching and excavations.  The was most recently documented on or about January 11, 2019 at or near Stable Road, Saint Louis, MO 63110, where employees were working inside a trench measuring 7.5 ft. deep X 6 ft. wide without protective helmets.  The spoil pile, tension cracks and loose debris were located between zero and twelve inches from the top edge of the excavation where employees were observed working without any head protection.

29 CFR 1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face. Such protection shall consist of scaling to remove loose material; installation of protective barricades at intervals as necessary on the face to stop and contain falling material; or other means that provide equivalent protection.  The employer is failing to protect employees from struck by hazards associated with working in trenching and excavations. This was most recently documented on or about January 11, 2019 at or near Stable Road, Saint Louis, MO 63110, Loose rocks and clumps of compacted soil were not removed from the edge of the excavation.  This condition exposed employees to objects falling or rolling into the excavation.

The employer is failing to protect employees from caught under/crushing hazards.  This was most recently documented on or about January 11, 2019 at or near Stable Road, Saint Louis, MO 63110, where the employer had the Caterpillar 326F Hydraulic Excavator operator lifting approximately 1000 lbs. of 15 inch reinforced concrete pipe over the head of an employee working inside the trench.

The employer is failing to protect employees from struck-by and engulfment hazards associated with trenching and excavations. This was most recently documented on or about January 11, 2019 at or near Stable Road, Saint Louis, MO 63110, employees were replacing a concrete storm drain pipe in an excavation measuring approximately 7.5 feet deep X 6 feet wide.  The competent person did not perform an adequate daily inspection of the excavation exposing employees to engulfment hazards.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:     The employer is failing to protect employees by ensuring the use of a ladder or other safe means of egress.  This was most recently documented on or about January 11, 2019 at or near Stable Road, Saint Louis, MO 63110, employees were replacing a concrete storm water drain pipe in an excavation measuring approximately 7.5 feet deep X 29 feet long X 6 feet wide.  A steep earthen ramp measuring an incline of approximately 50-60 degrees was used as access and egress, the path of egress was blocked by the Caterpillar 326 F Excavator bucket. The employees were working on the East side of the trench 25 feet from a safe means of egress.

The employer did not provide or require the use of benching, sloping, shoring or other means to ensure that employees working in excavations were protected from engulfment hazards.
