29 CFR 1926.451(f)(3):   Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift,  and after any occurrence which could affect a scaffolds structural integrity:    a) Employer did not provide a competent inspection of the scaffold; the employer rigged the single point suspended scaffold (man basket) whereby the work platform, suspension cable and lifeline chafe against the building and be exposed to damage. Employees were exposed to fall hazard.    Location: 325 W 38th Street, New York NY    On or about 1-11-2019    NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.452(o)(2): The employer did not ensure that the supporting rope between the scaffold and the suspension device was kept vertical unless:  --- 1926.452(o)(2)(i) The rigging has been designed by a qualified person, and  --- 1926.452(o)(2)(iii) The supporting rope is protected to ensure that it will not chafe at any point where a change in direction occurs:    a) Scaffold suspension rope was not kept vertical; the employer rigged the single point suspended scaffold (man basket) to go out over the edge of a roof setback and was not vertical over the scaffold.
