29 CFR 1910.28(b)(6)(i): The employer did not ensure each employee less than 4 feet (1.2 m) above dangerous equipment was protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system when the equipment was not covered or guarded to eliminate the hazard:    a) On or about January 15, 2019, employees were exposed to fall and drowning hazards when standing on wood planks to  access the retention pit #1 to remove expandable polystyrene beads from water.  The guardrail system had a missing section including top and mid rail.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    At the expandable polystyrene production located at 4447 Old US Hwy 41 S. Ruskin, FL:    a) The Hirsch 1400 (press #11) operator was exposed to continuous noise levels at 80.7% of the allowable 8 hour TWA-Action Limit (85 dBA).  The equivalent dBA level of 80.7% is 88.5 dBA.  The sampling was performed for 455 minutes during one shift on May 15, 2019.    b) The Modix (press #12) operator was exposed to continuous noise levels at 94.14% of the allowable 8 hour TWA-Action Limit (85 dBA).  The equivalent dBA level of 94.14% is 89.6 dBA.  The sampling was performed for 464 minutes during one shift on May 15, 2019.    c) The Heitz 1460(press #1) operator was exposed to continuous noise levels at 179.2% of the allowable 8 hour TWA-Action Limit (85 dBA).  The equivalent dBA level of 179.2% is 94.2 dBA.  The sampling was performed for 475 minutes during one shift on May 15, 2019.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    On or about January 15, 2019, at the expandable polystyrene production located at 4447 Old US Hwy 41 S. Ruskin, FL:    a)  The Modix - Press #12: there was a 4 ft. 4 in. by 1 ft. 8 in. opening on the south-east of the machine where machine operators and shift supervisors entered to retrieve lids, exposing to struck-by hazards from the mold tool as it moves backwards to release the molded pieces.     b) Heitz 1460 - Press #1: the north side of the machine in which the operator retrieves the molded pieces using a 6ft. pole with a hook, was completely unguarded.  The right side gate interlock switches were non-operational allowing the press to run with the gate in the up-right position, exposing employees to caught-in and struck-by hazards.      c)Heitz - Press #6: the right and left side gates were severely rusted and the interlocks were missing or non-operational, exposing employees to caught-in and struck-by hazards from the mold tool as it moves back and forth during operation.     d) Hirsch 1400 - Press #11; the southeast side of the machine, in which the machine operator retrieves the molded pieces as they fall from the mold tool into a wood pallet on top of expandable polystyrene containers, was not guarded, exposing employees to caught-in and struck-by hazards.
