29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about the 114-day period of September 22, 2018 - January 14, 2019, employees were performing excavation work at 15 jobsites that had not been instructed on the applicable procedures and/or regulations to recognize, avoid and/or minimize those hazards of which a reasonably prudent employer would have been aware of while performing this work. Payne Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1317617, citation number 1, item number 1 and was affirmed as a final order on 9/21/2018, with respect to a workplace located at 1748 Springmeadow Drive, Xenia OH 45385.
