29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) New townhome construction located on Lot #197, Rear side: On or about 01/15/2019, and at times prior, the employer exposed employees to ejection/fall hazards while working from a Genie S-45 Aerial Lift at heights of approximately 24-feet from the lower level, in that personal fall arrest systems were not provided to employees performing deck framing work as employees were not connected to the anchor points provided.

29 CFR 1926.454(a)(3): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the proper use of the scaffold, and the proper handling of materials on the scaffold. (a) New townhome construction located on Lot #197, Rear side: On or about 01/15/2019, and at times prior, the employer failed to train the operators of the Genie S-45 Aerial Lift on proper use of the equipment and personal protective equipment needed prior to use, in that employees operated the aerial lift at heights of 24-feet without donning a full body harness and attaching to the anchor points provided with a lanyard.
