29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) Pinebrook Shopping Center Sign (Outside Area): On or about January 16, 2019, the employer allowed his exposed employee(s) to perform service and maintenance activities such as but not limited to replacing in-kind light-bulbs and ballasts without fall protection; exposing his employee(s) to fall hazards of approximately fifty (50) feet to the concrete and ground below. b) Pinebrook Shopping Center Sign (Inside Area): On or about January 16, 2019, the employer allowed his exposed employee(s) to perform service and maintenance activities such as but not limited to replacing in-kind light-bulbs and ballasts without fall protection; exposing his employee(s) to fall hazards of approximately twenty-five (25) feet to the concrete and ground below.

29 CFR 1910.333(b)(2): While an employee was exposed to contact with parts of fixed electric equipment or circuits which were deenergized, the circuits energizing the parts were not locked out or tagged or both in accordance with the requirements of this paragraph (b) of 29 CFR 1910.333(b)(2): a) Pinebrook Shopping Center Sign Area: On or about January 16, 2019, the employer exposed employees to electrical shock hazards in that employees were allowed to replace light-bulbs and ballasts without locking out or tagging out the electrical energy sources of the equipment.
