29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Aspen Contracting Inc, at 101 W Cherry Street, Louisville, CO: On and preceding 1/16/19, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). Aspen Contracting Inc directed the work of Pantera Roofing. Employees of Pantera Roofing were replacing the sheet metal corrugated roof of a barn. Aspen Contracting Inc did not perform an inspection of the jobsite to determine the construction of the barn's roof and its impact upon the installation of a fall protection system for the subcontractor employees or other hazards at the jobsite. This condition exposed employees of Pantera Roofing to approximate 10.4 foot to 13.8 foot fall hazards.
