OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from working near skid-steer operations, to include backing maneuvers, without the benefit of a signal person or worksite controls to prevent contact with the equipment: (a) Worksite: On or about 1/17/2019, the employer did not ensure that the necessary worksite controls were established (to include proper training, signage and/or signal person) to prevent employees and pedestrians from entering the path of the skid-steer during operations.
