29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations. On or about January 16, 2019, a subcontractor's employees were exposed to a struck by hazard while demolishing an exterior elevator shaft located at 8630 Evins Ave., Cleveland, Ohio 44104. A subcontractor's employee was using a 400 excavator to demolish the shaft and the employer did not ensure that an engineering survey was done by a competent person to address the possibility of unplanned collapse. Independence Excavating Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.850 (a), which was contained in OSHA inspection number 1079955 citation number 1, item number 1 and was affirmed as a final order on 4/29/2016, with respect to a workplace located at 1708 South Point, Cleveland, Ohio 44109.

29 CFR 1926.859(g): During demolition, continuing inspections by a competent person were not made as the work progressed to detect hazards resulting from weakened or deteriorated floors, or walls, or loosened material. Employees were also permitted to work where such hazards existed without being corrected by shoring, bracing, or other effective means. On or about January 16, 2019, a subcontractor's employees were exposed to a struck by hazard while demolishing an exterior elevator shaft located at 8630 Evins Ave., Cleveland, Ohio 44104. A subcontractor's employee was using a 400 excavator to demolish the shaft and the employer did not ensure that continuing inspections were done by a competent person.
