29 CFR 1910.95(c)(1) is applicable to longshoring employment by 29 CFR 1918.1(b)(6) that incorporates the General Industry requirement: The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: M/V North Star, 2nd Deck: On or about January 22, 2019, during marine cargo handling operations where noise exposures exceeded an 8-hour time-weighted average of 85 decibels on the A scale or exceeded a dose equivalent of fifty percent, the employer had not implemented a continuing, effective hearing conservation program. This condition exposed employees to hearing loss.

29 CFR 1917.128(b)(1): The marine terminal did not have conspicuous signs posted indicating the locations of first aid facilities: Maintenance Shop: On or about January 22, 2019, where the need existed to access an emergency eye wash station, a conspicuously posted sign was not present for the maintenance. This condition exposed employees to delay in accessing an eyewash station.
