29 CFR 1910.28(b)(3)(iv): The employer did not ensure each employee was protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used.  a) Shaker, Rear 225 North Cedar Street, Hazleton, PA - The ladderway floor hole to the vault beneath the shaker was not guarded by an adequate guardrail system and self-closing gate or offset exposing employees to a ten (10) foot fall hazard, on or about January 25, 2019.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  a) Facility, Rear 225 North Cedar Street, Hazleton, PA - Employees operated a Yale Electric Pallet Jack (Model MLW06008CN12T92760 (Serial No. B828NO1725V) and transported materials without having received documented/certified formal instruction, practical training, or an operator evaluation thereby exposing themselves and other employees to struck-by hazards, on or about January 25, 2019.  b) Facility, Rear 225 North Cedar Street, Hazleton, PA - Employees operated a Baker Electric Pallet Jack (Model PAL-W) and transported materials without having received documented/certified formal instruction, practical training, or an operator evaluation thereby exposing themselves and other employees to struck-by hazards, on or about January 25, 2019.  In accordance with 29 CFR 1903.19, abatement certification is required for this violation.
