29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) On or about January 28, 2019, at the warehouse, employees were reaching up to the storage racks using two homemade man-lifts consisting of a wood pallet with a top-rail bolted to it that have not been approved by the forklift manufacturer, exposing to a 10-feet fall hazard.

The employer did not have a respiratory protection program.
