29 CFR 1910.106(d)(3)(ii): "Fire resistance." Storage cabinets shall be designed and constructed to limit the internal temperature to not more than 325 deg. F. when subjected to a 10-minute fire test using the standard time-temperature curve as set forth in Standard Methods of Fire Tests of Building Construction and Materials, NFPA 251-1969, which is incorporated by reference as specified in Sec. 1910.6. All joints and seams shall remain tight and the door shall remain securely closed during the fire test. Cabinets shall be labeled in conspicuous lettering, "Flammable - Keep Fire Away." a. On or about January 29, 2019, flammable materials were being stored in a metal storage cabinet that was not an approved fire resistant cabinet, thereby exposing employees to a fire hazard. Flammable materials stored in the cabinet included, but not limited to, aerosols and solvent cleaners.

29 CFR 1910.243(c)(3): Vertical portable grinders. Safety guards used on machines known as right angle head or vertical portable grinders shall have a maximum exposure angle of 180 deg., and the guard shall be so located so as to be between the operator and the wheel during use. Adjustment of guard shall be such that pieces of an accidentally broken wheel will be deflected away from the operator. a. On or about January 29, 2019, employees were using a DeWALT D28402 angle grinder with a cut off wheel to grind and sharpen landscaping tools. The employer did not ensure that the grinder was equipped with a safety guard, thereby exposing employees to a struck by hazard.
