29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:     On or about 01/29/2019, River-Roads Sales & Leasing, located at 9010 Hall Street, St. Louis, MO, had not established a program consisting of energy control procedures, employee training and periodic inspections.  The employees were exposed to the Kalamazoo vertical saw (Model: Startrite 30 RF, S/N: M66630) which was hard wired for electrical energy.  This would require a lock out device during blade change out since the authorized person would not have direct control.  Also, eighteen wheelers trailers required some method(s) to prevent movement or shifting, and at time the trailers were still connected to truck cab(s) which would require additional LO/TO procedures.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):     On or about 01/29/2019, River-Roads Sales & Leasing, located at 9010 Hall Street, St. Louis, MO, the forklift operator(s) and employee(s) were exposed to a forklift in need of repair.  The horn on the Kalmar AC forklift (Model: C 50B L PS, S/N: 407233A) was not functional when tested.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:     On or about 01/29/2019, River-Roads Sales & Leasing, located at 9010 Hall Street, St. Louis, MO, employees were exposed to hazards such as those created by rotating parts of the nonworking portion of the saw blade on the Kalamazoo vertical band saw (Model: Startrite 30RF, S/N: M66630).  This vertical band saw had no guard above its point of operation.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     On or about 01/29/2019, River-Roads Sales & Leasing, located at 9010 Hall Street, St. Louis, MO, had not established a Hazard Communication Program with corresponding safety data sheets and employee training.  The employees were exposed to various paints, oils, and grease which contain various hazards to the employee(s) utilizing them.  There were such products as:   1)     Seymour Medium Gray BIG RIG paint which was flammable, a compressed gas (aerosol), an irritant and had an acute hazard;   2)     Mystic JT6 grease with eye hazard, ingestion warnings and warning when to take for medical treatment; and   3)     Shell Spirax S4 AX 80W-90 oil which also had various hazard warnings.

A recordable incident had occurred on 5-29-2018 which required medical treatment.
