29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazards;    a) On or about 01/28/19 in the Repair area; employees were exposed to crushing and piercing foot injuries caused by dropping wooden pallets ( weighing 70 pounds) or stepping on nails and the employer required only heavy soled work shoes.     b) On or about 01/28/19 in the Sorter area; employer JSA dated 2010 identified falling pallets (weighing 70 pounds) as a Potential Hazard and employer required only heavy soled work shoes.        c) On or about 01/28/19 in the Baler area; employees working around the baler were exposed to crushing foot injuries when powered industrial trucks ran over their foot (recordable incidents in 2017 and 2018) and the employer continued to require only heavy soled work shoes.      ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.136(a): The employer did not ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole:  a) On or about 01/28/19 baler area; employees were exposed to crushing foot injuries caused by being run over by powered industrial trucks being operated in this area.    b) On or about 01/28/19 in the Sorter area; employees were exposed to crushing and piercing foot injuries caused by dropping  wooden pallets (weighing 70 pounds) or stepping on nails.      c) On or about 01/28/19 in the Repair area; employees were exposed to crushing and piercing foot injuries caused by dropping wooden pallets (weighing 70 pounds) or stepping on nails. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) On or about 01/28/19 in the Sorter area; employees were exposed to potential crushing injuries during the operation of the stacker straighter when access to the point of operation on this section of the machine was not guarded.    b) On or about 01/28/19 in the Sorter area; employees were exposed to potential crushing injuries during the operation of the up-ender when access to the point of operation on this section of the machine was not guarded.    c) On or about 01/28/19 in the Sorter area; employees were exposed to potential crushing injuries during the operation of the pallet rotator when access to the point of operation on this section of the machine was not guarded.
