OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and  a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards of moving vehicles:    The employer is failing to protect employees from vehicular struck-by hazards associated with the backing of vehicles with limited/restricted view to the rear. This was most recently documented on January 30, 2019 at the establishment located at 330 W. Rosewood St. Rose Hill, Kansas. The employer did not ensure:        a. Vehicles and equipment such as but not limited to a Dodge Ram 3500 Heavy Duty Truck and attached trailer with restricted view to the rear were equipped with an audible back up alarm and/or spotters used any time vehicles are being operated in reverse.       b. Employees were trained to be observant of their surroundings when walking/working in and around areas where vehicles and equipment are being operated such as the vehicle and equipment barn.        c. Employees were provided or required to wear high visibility shirts, jackets, or vests when working in and around motorized vehicles and equipment.    Among other methods, one feasible and acceptable abatement method is to:    a) Train employees on procedures to be following when operating equipment in reverse with limited view to the rear to include maintaining eye contact with other employees and the use of observers/spotters.     b) Install an audible backup alarm that is distinguishable from other horn signals and can be heard above the surrounding noise level.     c) Provide and ensure the use of high visibility shirts, jackets, or vests when working in and around motorized vehicles and equipment.
