29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d):  29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.   Whataburger Construction: On or about January 31, 2019, and at times prior thereto, employees were operating a JLG SkyTrak Telehandler 6042 Terrain truck (SN: 10070645) to elevate a job made wooden platform without training and certification.

29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables used for temporary wiring were not protected from damage:  On or about January 31, 2019 and at times prior thereto, employees were exposed to electrical hazards when performing framing work while using a damaged flexible cord to power a nail gun.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.   Whataburger Construction Project: On or about January 31, 2019, and at times prior thereto, employees were exposed to a fall hazard while using a job made wooden platform that was elevated and supported by a JLG SkyTrak Telehandler 6042 Terrain truck so that employees could frame the upper portions of the building.
