29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On February 4, 2019, there were no frequent and regular inspections being performed by a competent person in that: (a) An employee was utilizing a pneumatic nail gun without wearing eye protection (b) An employee was not maintaining 3 points of contact while carrying roofing shingles when climbing a portable ladder (c) Employees were using a portable ladder that was not installed on a stable and level surface. The base of the ladder was set on a foot stool and propped up against the exterior wall of the residence (d) Employees were using a ladder with an angle that was not properly set. The base of the ladder was more than a quarter of the working length of the ladder from the wall or other vertical surface (e) Employees were working without head protection while underneath a gazebo roof structure under construction (f) Employees were working from a steep pitch gazebo roof at fall heights greater than 8 feet (west side) and 15 feet (all other sides) above the ground below without a fall protection system

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On February 4, 2019, located throughout a gazebo roof structure, employees were performing roofing work on a steep pitch roof with unprotected sides and edges while not utilizing a fall protection system. Potential fall heights were measured to be greater than 8 feet (west side) and 15 feet (all other sides) above the ground below.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The employer did not provide a training program for employees performing roofing work on a steep pitch gazebo roof structure while not utilizing a fall protection system and exposed to fall heights greater than 8 feet (west side) and 16 feet (all other sides) above the ground below.
