OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards due to damaged storage racks: a) On or about February 01, 2019 and at times prior thereto; the employer failed to ensure that at least two (2) free standing damaged storage racks whose structural integrity had become compromised were repaired or that section(s) of racks were taken out of service until they could be repaired which exposed employees to the hazards associated with getting struck-by or crushed-by falling product and/or sections of rack. NOTE: Abatement certification IS required for this item.

(b) Warehouse, on or about February 1, 2019; the coasters on the green mobile ladder did not lock when weight was applied. NOTE: Abatement certification IS required for this item.
