29 CFR 1926.503(c): When the employer had reason to believe that any affected employee who was already trained did not have the understanding and skill required by paragraph (a) of this section, the employer did not retrain each such employee: a) Job site, 160 and 170 East Carson Street, Pittsburgh, PA: On or about February 4, 2019, during framing activities, the employer did not ensure that employees were provided fall protection retraining where appropriate. Deficiencies noted during the inspection included, but were not limited to, failing to use appropriate fall protection systems/devices where toprails were missing in a guardrail system, when making guardrail system repairs or where guardrail systems were removed during material landing activities, all of which exposed employees to fall hazards of up to at least approximately 30 feet.

29 CFR 1926.20(b)(2): The employer did not ensure that a program that provided for frequent and regular inspections of the job sites, materials, and equipment made by competent persons was implemented: a) Job site, 160 and 170 East Carson Street, Pittsburgh, PA: On or about February 28, 2019, during framing activities, the employer did not ensure that an appropriate system was in place to identify and correct safety hazards at the worksite. Deficiencies noted during the inspection included, but were not limited to, inappropriately attached wooden barriers near an elevator shaft, cords/hoses strewn about on the floor posing a tripping hazard and wooden guardrail systems that were not properly installed, had missing midrails and/or that were too short to serve as fall protection.
