29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. On February 4, 2019, located at intersection of Crestfield Ct., & Fields Ertle Rd, employees were exposed to a struck-by hazards as the employer did not have an effective Temporary Traffic Control program or policies, including procedures for working safely in or near roadway construction, maintenance, and utility (work zone) operations that had not been developed, documented and utilized to promote road/highway safety to employees and provide warning and guidance needed for the reasonably safe, uniform, and efficient operation of all elements of the traffic stream. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On February 4, 2019, located at intersection of Crestfield Ct., & Fields Ertle Rd, there were no frequent and regular Temporary Traffic Control inspections being performed or maintained by a competent person to ensure the jobsite, materials and equipment such as wearing of high visibility clothing, traffic control channelization devices and work zone signs were being maintained and utilized in a safe condition. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On February 4, 2019, located at intersection of Crestfield Ct., & Fields Ertle Rd, an employee was performing flagging operation while exposed to struck-by hazards by vehicular traffic during a Temporary Traffic Control Zone. The employee had not been instructed by the employer in recognition and avoidance of unsafe conditions to control or eliminate any hazards associated with flagging operations. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
