29 CFR 1910.147(e)(2)(i): Before lockout or tagout devices were removed and energy was restored to the machine or equipment, authorized employees did not ensure that all employees had been safely positioned or removed from the work area: a) On or about January 25, 2019, the employer did not ensure employees performing the testing and positioning were safely positioned away from energized equipment such as the BPRT bump test in that the equipment was energized while an employee's hand was located inside the motor compartment.

29 CFR 1910.147(f)(1): Testing or positioning of machines, equipment or components thereof. In situations in which lockout or tagout devices must be temporarily removed from the energy isolating device and the machine or equipment energized to test or position the machine, equipment or component thereof, the following sequence of actions shall be followed: (ii) Remove employees from the machine or equipment area in accordance with paragraph (e)(2) of this section a) On or about January 25, 2019, employees were not removed from the Bulk Product Recovery Tank (BPRT) motor bump test prior to removing the lock from the main disconnect inside the bulk fuel storage transfer facility.
