Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use. a) The employer had not obtained a safety data sheet for the red cans of CRC Brakleen Brake Parts Cleaner Strongest Brakleen Formula used in the facility on or about January 31, 2019.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets: a) On or about January 31, 2019, the employee using the red cans of CRC Brakleen Brake Parts Cleaner Strongest Brakleen Formula in the facility was not trained that using the product near welding operations could cause the generation of chlorine, hydrogen chloride or phosgene.

29 CFR 1910.1026(d)(1): General. Each employer who has a workplace or work operation covered by this section shall determine the 8-hour TWA exposure for each employee exposed to chromium (VI). This determination shall be made in accordance with either paragraph (d)(2) or paragraph (d)(3) of this section: a) On or about February 5, 2019, the employer had not conducted initial monitoring for welders welding on stainless steel. A portion of the chromium content contained in stainless steel is known to convert to chromium (VI) during the welding process.
