29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    A) Neifer Carpentry, LLC on or about February 5, 2019 at the address of 131 East Water Street, Sandusky, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. The untrained forklift operator did not recognize the hazard associated with performing work tasks under an elevated load and was exposed to struck-by and crushing hazards.

A) Neifer Carpentry, LLC on or about February 5, 2019 at the address of 131 East Water Street, Sandusky, OH: The employer did not ensure employees were protected from head injuries while working below an elevated dumpster as employees were throwing out debris from an upper level window. Due to this condition, employees were exposed to impact injuries caused from falling material and/or equipment.

29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the framing floors and walls and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations.    A) Neifer Carpentry, LLC on or about February 5, 2019 at the address of 131 East Water Street, Sandusky, Ohio: The employer did not ensure the structure and temporary supports used were surveyed by an engineer for structural integrity prior to the performance of demolition work. Employees preforming demolition work from inside the structure in this condition were exposed to crushing hazards.
