29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)  New townhome construction on Building #6, Third level: On or about 02/05/2019, and at times prior, the employer exposed employees to fall hazards of 19-feet, 11-inches to the lower level, in that a fall protection system was not provided to employees engaged in framing activities near the edge of the walking/working surface.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  (a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)  (a) New townhome construction on Building #6, Ladder located between floors 1 and 2: On or about 02/05/2019, and at times prior, the employer exposed employees to fall hazards of 12-feet, 7-inches to the lower level, in that the ladder provided was not extended at least 3-feet past the landing or secured to allow safe access to the upper and lower levels.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  (a) New townhome construction on Building #6, Ladder located between floors 1 and 2: On or about 02/05/2019, and at times prior, the employer exposed employees to fall hazards of 12-feet, 7-inches to the lower level, in that the ladder provided had side rails which were both damaged and missing and not removed from service prior to the start of the work shift.
