29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets.  On or about February 6, 2019, employees were unloading roofing materials from the roof of the three story building under construction in the fall zone without head protection, exposing employees the hazard of being struck by materials or equipment.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  On or about February 6, 2019, and at times prior thereto, employees were using pneumatic nail guns for installing the roof of the residential apartment buildings under construction without eye protection, exposing employees to the hazard of being struck by flying objects.

29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction 6 feet (1.8 m) or more above lower levels were not protected from falling by the use of guardrail systems, safety net systems or personal fall arrest systems nor was an alternative fall protection plan which meets the requirements of 1926.502(k) developed and implemented:  On or about February 6, 2019, and at times prior thereto, employees were conducting roofing operations on the three story apartment building approximately 32 feet high without fall protection, exposing employees to a fall hazard.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  The employer did not provide a training program for all employees exposed to fall hazards.  The program shall include training and instruction in the following areas: a)  The recognition and identification of fall hazards in the work area; b)  The use and operation of guardrail systems (including perimeter safety cable systems), personal fall arrest systems, positioning device systems, fall restraint systems, safety net systems, and other protection to be used; c)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; d)  The procedures to be followed to prevent falls to lower levels and through or into holes and openings in walking/working surfaces and walls; and e)  The fall protection requirements of this subpart.
