29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) Metro Machinery Rigging Inc. at 20670 County Road 85 Tower 55 Fleming, CO 80728:  On or before February 5, 2019 the exposing employer did not ensure that employees working in forklifts were trained to operate the lift. The employer did not train and evaluate each operator who is authorized to operate the JLG G15-44A Telehandler forklift to ensure they were competent to operate the forklift safely. This exposed employees to potential struck by and struck against hazards.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  (a) Metro Machinery Rigging Inc. at 20670 County Road 85 Tower 55 Fleming, CO 80728:  On or before February 5, 2019, the employer modified the JLG G15-44A Telehandler forklift and affected its capacity and safe operation without the manufacturer's written approval.  The employer connected chain slings to the forklift tines without the use of an approved attachment point (free rigging), and used these slings to lift Liebherr 1400 Crawler Crane counterweights that weighed 10 metric tons each (22,000 lbs). Employees were exposed to struck-by hazards.

29 CFR 1910.178(o)(2): Load(s) were being handled which exceeded the rated capacity of the industrial truck.  (a) Metro Machinery Rigging Inc. at 20670 County Road 85 Tower 55 Fleming, CO 80728:  On or before February 5, 2019 the exposing employer did not ensure that employees operating forklifts were lifting loads within the rated capacity of the forklift. The employer rented a JLG G15-44A Telehandler forklift from United Rentals with a maximum rated capacity of 15,000 lbs. The JLG G15-44A Telehandler forklift was being used to lift Liebherr 1400 Crawler Crane counterweights that weighed 10 metric tons each (22,000 lbs). Employees were exposed to struck by hazards when working near forklifts carrying loads exceeding the maximum rated capacity of the forklift.  Abatement note:  ANSI B56.6 Safety Standard For Rough Terrain Fork Lift Trucks 6.4.7(a)(1) states "when handling suspended loads do not exceed the truck manufacturer's capacity of the rough terrain forklift truck as equipped for handling suspended loads."

29 CFR 1910.184(c)(9): Employee(s) were not kept clear of load(s) suspended, or about to be lifted by sling(s):  (a) Metro Machinery Rigging Inc. at 20670 County Road 85 Tower 55 Fleming, CO 80728:  On or before February 5, 2019 the exposing employer did not ensure that employees were kept clear of loads being lifted by slings. A JLG G15-44A Telehandler forklift was being used along with chains connected to the forks to lift counterweights which weighed 22,000 lbs each. An employee was standing in between two stacks of counterweights, approximately 21 inches apart, while one of the counterweights was being hoisted. As the counterweight was hoisted by the slings, the counterweight rotated in the slings and crushed an employee's head in between the two stacks.
