29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Store Floor, 620 Kidder Street, Wilkes-Barre, PA - Employees engaged in the removal of metal shelving and fixtures attached to walls or the ceiling were not trained to recognize the unsafe conditions and regulations associated with ladders and the need to utilize personal protective equipment exposing employees to struck-by hazards, on or about February 7, 2019. In accordance with 29 CFR 1903.19, abatement certification is not required for this violation as the hazardous condition was corrected during the inspection.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: a) Store Floor, 620 Kidder Street, Wilkes-Barre, PA - Employees engaged in the removal of metal shelving and fixtures from walls and the ceiling worked beneath employees on step ladders without wearing a protective helmet which exposed the employees to struck-by hazards in the event that tools or material fell, on or about February 7, 2019. In accordance with 29 CFR 1903.19, abatement certification is not required for this violation as the hazardous condition was corrected during the inspection
