29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent.  On or about February 6, 2019 and times prior thereto an effective hearing conservation program which included noise monitoring, audiometric testing of employees, training of employees, and retention of exposure measurements as detailed in the standard was not instituted by the employer.  Employee(s) required to work in the production floors and surrounding areas were exposed to sound levels in excess of the 8 hour Time Weighted Average Action Level of 85 decibels on an A-weighted scale (dBA). These conditions exposed employees to noise hazards:  a) Employee(s) working in the kill floor were exposed to sound level decibels in an 8-hour Time Weighted Average (TWA) up to a 177.9% dose which is equivalent to approximately 94.1 dBA and approximately 1.77 times the Permissible Exposure Limit (PEL) of 90 dBA. The noise sampling was performed for 481 minutes with an exposure of zero assumed for additional work time not sampled.   b) Employees working on the processing floor were exposed to sound level decibels in an 8-hour Time Weighted Average (TWA) up to a 76.7% dose which is equivalent to approximately 88 dBA and approximately 1.97 times the exposure level of 85 dBA that requires the implementation of a hearing conservation program.   c)  Employees performing Quality Assurance operations were exposed to sound level decibels in an 8-hour Time Weighted Average (TWA) up to a 89.5% dose which is equivalent to approximately 89.2 dBA and approximately 2.17 times the exposure level of 85 dBA that requires the implementation of a hearing conservation program.

29 CFR 1910.132(h)(1): Except as provided by paragraphs (h)(2) through (h)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees.  On or about February 6, 2019 and at times prior thereto, employee(s) received pay deductions from employer for the supplying of personal protective equipment such as but no limited to steel toe slip resistant rubber boots, arm guards, aprons, and vinyl sleeves.

On or about February 6, 2019 and at times prior thereto the employer did not have safety data sheets in the workplace for employees performing maintenance operations and using products such as but not limited to, welding gases Oxygen and Acetylene, Welding Rods, and WD-40, exposing employees to health hazards.
