29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) New residential construction located on Lot #37, East side of structure on Goswick Way, On or about 02/11/2019, and at times prior, the employer allowed employees to operate rough terrain powered industrial forklift trucks without certification, evaluation, and training on the type of truck they were operating.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  (a) New residential construction located on Lot #37, Third floor: On or about 02/11/2019, and at times prior, the employer exposed employees to struck-by hazards while using a pneumatic Hitachi (Model - NR83AS1) 3-1/2-inch Framing Nail Gun, in that no protective eyewear was provided to the employee engaged in framing activities operating the nailer at 150 PSI.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New residential construction located on Lot #37, Third level, On or about 02/11/2019, and at times prior, the employer exposed employees to fall hazards of 22-feet, 10-inches to the lower level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) New residential construction located on Lot #37, First level, On or about 02/11/2019, and at times prior, the employer exposed employees to fall hazards of up to 10-feet, 7-inches to the concrete surface below, in that the portable ladder provided did not extend at least 3-feet past the second floor landing to allow for safe access between levels.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  (a) New residential construction located on Lot #37, First level, On or about 02/11/2019, and at times prior, the employer exposed employees to fall hazards of up to 5-feet, 10-inches to the lower concrete surface, in that the ladder used to access the second level had a damaged spreader on the right side of the ladder which was not removed from service immediately.
