NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:       a) On or about 2/11/19, in a trench/excavation at a jobsite in front of 180 Avery Ave., Buffalo, NY: The spoil pile was placed on the west bank of the trench and approx. 5 inches away from the trench that was 5 ft. 2 inches deep x approx. 34 inches wide x approx. 20 ft. long., and no retaining device to prevent materials or equipment from falling or rolling into excavations was used.        NO ABATEMENT CERTIFICATION REQUIRED

The east and west banks of the trench were vertical. No cave-in protection was provided.         NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:        a) On or about 2/11/19, in a trench/excavation in front of 180 Avery Ave., Buffalo, NY: Employee(s) engaged in a sewer line repair went into in a trench that was 5 ft. 2 inches deep without any cave-in protection. The employee(s) was not trained to recognize potential hazards on this type of jobsite, including but not limited to cave-in hazards, proper access to excavations, spoil pile hazards & requirements, soil classification, the need for personal protective equipment such as but not limited to hard hats and the applicable OSHA regulations to control or eliminate these hazards.        ABATEMENT CERTIFICATION REQUIRED
