29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  a)  At 40 Park Beach Dr., Lot 23 Parks Edge, Orange Beach, Alabama:  On or about February 11, 2019 and at times prior; the employer failed to ensure a ladder was in place for employees to use to get on and off the ladder jack scaffold platform exposing his employees to a fall hazard of 11.8 feet to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  At 40 Park Beach Dr., Lot 23 Parks Edge, Orange Beach, Alabama:  On or about February 11, 2019 and at times prior; the employer allowed his employees to use an extension ladder to gain access to the roof top and the rails of the ladder did not extend three feet above the landing to provide safe access exposing his employees to a fall hazard of 11.8 feet to the ground below.
